Welcome to BWD Motorsports. These Terms of Service govern your access to and use of the BWD Motorsports website, services, media, content, and related offerings. By using our website, booking services, purchasing products, or working with BWD Motorsports, you agree to these Terms.
1. About BWD Motorsports
BWD Motorsports provides photography, videography, media production, marketing content, and related motorsports media services. Services may include event coverage, private shoots, commercial content, social media deliverables, digital galleries, prints, licensing, and related creative work.
2. Use of Our Website
You agree to use our website only for lawful purposes. You may not use the website to:
Violate any applicable law or regulation
Interfere with the security or operation of the website
Attempt to gain unauthorized access to any system or account
Copy, scrape, reproduce, or misuse website content without permission
Submit false, misleading, harmful, or unauthorized information
We may restrict or terminate access to the website at any time if we believe these Terms have been violated.
3. Bookings and Services
Bookings, projects, or service requests may be subject to separate written agreements, invoices, proposals, usage terms, or client approvals. If there is a conflict between these Terms and a signed written agreement, the signed written agreement will control.
BWD Motorsports reserves the right to accept, decline, reschedule, or cancel service requests at our discretion, including due to weather, safety concerns, event restrictions, access limitations, illness, equipment issues, scheduling conflicts, nonpayment, or circumstances outside our control.
4. Client Responsibilities
Clients are responsible for providing accurate project information, event details, access credentials, schedules, shot lists, branding requirements, deadlines, and any permissions necessary for BWD Motorsports to perform the requested services.
Clients are also responsible for obtaining any required approvals, track access, pit passes, media credentials, property permissions, vehicle access, sponsor approvals, or participant consent unless otherwise agreed in writing.
BWD Motorsports is not responsible for missed coverage, limited deliverables, or project delays caused by inaccurate information, lack of access, denied credentials, unsafe conditions, restricted areas, schedule changes, or third-party decisions.
5. Payments, Deposits, and Fees
Pricing, deposits, payment schedules, and deliverables will be stated in the applicable invoice, proposal, checkout page, or written agreement.
Unless otherwise agreed in writing:
Deposits or retainers may be required to reserve a booking date
Deposits may be non-refundable once a date or project time has been reserved
Final deliverables may be withheld until payment is received in full
Late payments may delay delivery or result in additional fees
Client-requested changes outside the original scope may require additional charges
6. Cancellations and Rescheduling
Cancellation and rescheduling terms may vary depending on the project, event, or agreement.
BWD Motorsports may work with clients in good faith to reschedule when possible, but rescheduling is subject to availability, event timing, travel requirements, and other commitments. Fees already paid may be applied to a future booking at BWD Motorsports’ discretion unless otherwise stated in writing.
7. Creative Control and Editing
BWD Motorsports retains creative discretion over photography, videography, editing, color grading, composition, sequencing, file selection, and final delivery unless specific requirements are agreed to in writing before the project begins.
Raw, unedited, or source files are not included unless expressly agreed in writing. BWD Motorsports is not required to deliver every image, clip, take, or file captured during a project.
8. Delivery of Media
Delivery timelines are estimates unless expressly guaranteed in writing. Delivery may be affected by project scope, event duration, travel, editing workload, client revisions, weather, technical issues, or third-party delays.
Digital deliverables may be provided by online gallery, file transfer, email, cloud storage, social media delivery, or another method chosen by BWD Motorsports.
Clients are responsible for downloading, saving, and backing up delivered files. BWD Motorsports may not guarantee indefinite storage or availability of galleries, links, or delivered media.
9. Revisions
If revisions are included, the number of revision rounds and scope of revisions will be stated in the applicable agreement, invoice, or project terms.
Unless otherwise agreed in writing, revisions do not include a complete re-edit, new creative direction, reshooting, changes to the original project scope, or edits caused by incomplete or inaccurate client instructions.
10. Ownership and Copyright
Unless otherwise agreed in writing, BWD Motorsports retains all copyrights and ownership rights in photos, videos, edits, designs, footage, and other creative works produced by BWD Motorsports.
Clients receive only the usage rights expressly granted in the applicable agreement, invoice, license, gallery terms, or written communication. No copyright ownership is transferred unless a written agreement expressly states that copyright is assigned.
11. Client License and Usage Rights
When media is delivered to a client, BWD Motorsports grants the client a limited license to use the final delivered media for the purposes agreed upon, such as personal use, team promotion, sponsor promotion, social media, website use, or marketing use.
Unless otherwise agreed in writing, clients may not:
Sell, sublicense, or redistribute media as standalone files
Claim ownership or authorship of the media
Submit media to commercial campaigns, publications, paid advertisements, sponsors, manufacturers, or third parties outside the agreed usage
Heavily alter, edit, filter, crop, watermark, or manipulate media in a way that misrepresents the original work
Use media in unlawful, defamatory, misleading, or harmful ways
Additional licensing may be required for commercial advertising, merchandise, print resale, editorial publication, sponsor campaigns, or third-party brand use.
12. Portfolio and Promotional Use
Unless otherwise agreed in writing, BWD Motorsports may use photos, videos, project materials, behind-the-scenes content, and completed deliverables for portfolio, website, social media, marketing, advertising, awards, editorial, or promotional purposes.
This may include displaying vehicles, drivers, teams, sponsors, crew members, event participants, and related branding captured in connection with motorsports activities.
13. Third-Party Rights and Permissions
Clients are responsible for ensuring that their use of delivered media does not violate the rights of any third party, including sponsors, brands, sanctioning bodies, tracks, event organizers, drivers, team members, spectators, music rights holders, trademark owners, or property owners.
BWD Motorsports is not responsible for how clients use delivered media after delivery.
14. Prints, Products, and Digital Downloads
Any prints, merchandise, downloads, or other products purchased through BWD Motorsports are subject to availability, production timelines, shipping timelines, vendor limitations, and product-specific terms.
Due to the custom nature of media products, all sales may be final unless otherwise stated. If a product arrives damaged or incorrect, contact us promptly so we can review the issue.
15. Website Content
All website content, including photos, videos, graphics, logos, text, designs, and branding, is owned by or licensed to BWD Motorsports and is protected by copyright, trademark, and other intellectual property laws.
You may not copy, download, reproduce, distribute, modify, sell, or use website content without prior written permission, except for normal personal viewing of the website.
16. Testimonials, Reviews, and User Submissions
If you submit testimonials, reviews, comments, tags, messages, photos, videos, or other content to BWD Motorsports, you grant BWD Motorsports permission to use, display, reproduce, edit, and share that content for business, promotional, marketing, and social media purposes.
You are responsible for ensuring that anything you submit is accurate, lawful, and does not infringe the rights of others.
17. Disclaimers
BWD Motorsports provides its website and services on an “as available” basis. We make reasonable efforts to provide professional service, but we do not guarantee that the website will be uninterrupted, error-free, secure, or free from harmful components.
Motorsports environments can be unpredictable. BWD Motorsports does not guarantee specific shots, angles, coverage moments, race outcomes, weather conditions, event access, participant availability, or third-party cooperation unless expressly agreed in writing.
18. Limitation of Liability
To the fullest extent permitted by law, BWD Motorsports is not liable for indirect, incidental, consequential, special, punitive, or lost-profit damages arising from your use of the website, services, products, or media.
To the fullest extent permitted by law, BWD Motorsports’ total liability for any claim related to services or products will not exceed the amount paid by the client for the specific service or product giving rise to the claim.
19. Indemnification
You agree to indemnify and hold harmless BWD Motorsports from any claims, damages, losses, liabilities, costs, or expenses arising from your use of the website, your use of delivered media, your violation of these Terms, your violation of third-party rights, or information and materials you provide to BWD Motorsports.
20. Force Majeure
BWD Motorsports is not responsible for delays, failures, cancellations, or inability to perform caused by events outside our reasonable control, including weather, natural disasters, accidents, illness, injury, equipment failure, power or internet outages, travel disruptions, government restrictions, event cancellations, track closures, credential denials, labor disputes, or other unforeseen circumstances.
21. Governing Law
These Terms are governed by the laws of the state where BWD Motorsports operates, without regard to conflict of law principles.
Any disputes will be handled in the appropriate courts located in that state or county, unless otherwise required by law or agreed in writing.
22. Changes to These Terms
BWD Motorsports may update these Terms from time to time. Updates will be posted on this page with a revised effective date. Continued use of the website or services after changes are posted means you accept the updated Terms.
